For Insurance Companies and ECAs
If you are or represent an insurance company and/or ECA who:
- has indemnified a claim under the insurance policy to your clients; and
- is subrogated in the insured (or whole) part of the rights to recover the claim with the debtor; or
- has a portfolio of paid-out claims for which a recovery solution is sought; and
- wishes to outsource the recovery and collection process of such (portfolio of) claim(s).
Omni Bridgeway offers recovery services that lead to a solution and monetization of your subrogated rights. Our tailor-made solutions include funding of international litigation and arbitration, debt recovery and trade and investment of defaulted debt.
Omni Bridgeway works on a strict no success, no fee basis. This means that all up-front fees of lawyers, experts, court fees and related expenses are paid by Omni Bridgeway in return for a share in the recovery proceeds. As Omni Bridgeway is only paid in the event of a positive outcome, the interests of both the holder of the subrogation rights and Omni Bridgeway are aligned.
Claims which can be recovered by Omni Bridgeway are:
- defaulted sovereign and quasi-sovereign debt, i.e. debt issued and/or guaranteed by (quasi-) sovereign entities in risk countries;
- defaulted bank debt, i.e. debt evidenced by loan documentation, letters of credit, promissory notes and bills of exchange issued and/or guaranteed by the central bank or other banks in risk countries;
- defaulted corporate debt, i.e. debt issued or guaranteed by private corporate entities in risk countries; or
- enforceable awards or legal titles,
- claims arising from inappropriate behaviour of sovereign entities such as expropriation, nationalisation, unreasonable taxation
Omni Bridgeway’s highly experienced legal and intelligence professionals help insurance companies manage the risk and cost of litigation and arbitration and ensure a recovery of the subrogation rights. We provide off-balance sheet, non-recourse financing for the indemnified claims, on a per claim or portfolio basis. This allows insurers to hedge their risk of recovery with the same tools and disciplines they use to hedge other risks of their insurance business.
Alongside all this, we offer several services to support successful litigation and recovery proceedings, such as custom made advice on complex cross-border litigation and arbitration and fact-finding missions.
Portfolio Management
Omni Bridgeway has successfully managed several portfolios for Export Credit Agencies, insurance companies, run-off vehicles and banks. Portfolio management includes the development and implementation of a recovery strategy, monitoring of market developments and assessment of tax aspects. Outsourcing the management of a portfolio to Omni Bridgeway allows the insurer to focus on current and future insurance business rather than spending time and money on litigation.
Pricing and Free Assessment Service
Omni Bridgeway is regularly requested to value distressed assets or portfolios of distressed assets listed above, including distressed debt eligible under HIPC (Heavily Indebted Poor Countries) and/or treated in Paris Club agreements. These valuations are used for:
- settlement with;
- pay out to;
- buy-back from
the insured of the uninsured portion.
Omni Bridgeway can also assess your claim or portfolio of claims to understand the probability and rate of success of a recovery process. Our assessment and pricing service is generally provided free of charge and on a no-obligation basis. Please complete the questionnaire and we will revert with our initial feedback.
Reference list and Track Record
Over the years, Omni Bridgeway has established a track record of successful recovery solutions, which solutions have included the investing in and subsequently recovering the defaulted debt, through legal means, amicable settlement or selling the claim to a strategic investor. A reference list and a track record containing some of the major transactions can be obtained on request.
