Turkish construction company turns to Omni Bridgeway to recover debts from Uzbekistan government

The situation

Having exhausted all avenues to enforce a favorable Award and recover monies owed by a parastatal of the Republic of Uzbekistan an exasperated Turkish construction company turned to Omni Bridgeway to devise and execute a recovery plan. The company had received an ICC Award in its favor when it pursued arbitration following non-payment for an irrigation construction project, but was unsuccessful in its attempts to recover the Award and sought our expertise,

Our role

• Identified and arrested the debtor’s assets in western jurisdictions 
• Undertook asset and enforcement actions in Belgium, France, Germany, Japan, Netherlands, Turkey and the US
• Anticipated, prepared for and contested the debtor’s claims of sovereign immunity and asset ownership in numerous jurisdictions
• Leveraged high-level contacts from a multilateral organization to negotiate a settlement in Manila, Philippines

The outcome

Through a combination of legal action in seven jurisdictions and subsequent negotiations including top officials of a relevant multilateral organization, a settlement was reached to the satisfaction of the client.
